PSYATWORK SL, hereinafter Psy@Home is the owner of this website and the e-Coaching Application (myCo@ch, (hereinafter the "Application"), and makes available to users ("User") Online Psychology services with professionals in the sector ("Professionals") and is responsible for the personal data provided by users through this website.

This document constitutes the terms and conditions of use (hereinafter, the "Terms and Conditions") that regulate the access and use of the Application available on the website located at the address "psyathome.com" (hereinafter "Website ") and on the Platform located at" mycoach.psyathome.com "(hereinafter, the" Application ").

Access to and use of the Application implies the express and unreserved acceptance of the terms of these Terms and Conditions, having the same validity and effectiveness as any contract entered into in writing and signed. Its observance and compliance will be required of any person who accesses or uses the Application. If you do not agree with the Terms and Conditions, it is recommended that you do not use it.

1. Purpose and scope of the platform

The purpose of these Terms and Conditions is to regulate the access and use of the Application. However, Psy@Home reserves the right to modify its presentation, configuration and content, as well as the necessary conditions for its access and / or use when necessary.

The modifications that are made in these Terms and Conditions will be published in the same way as they appear through a communication addressed to the Users indicating the date of their effective delivery. The access and use of the Application after the entry into force of the modifications or changes of these Terms and Conditions implies its full acceptance.

 

For the purposes of interpreting these Terms and Conditions, we inform you that a person is considered to be a User of the Application at the moment they accept these Terms and Conditions, being sufficient for this to make use of it.

 

2. Access, registration and withdrawal from the platform

 

2.1. Access

 

Access to the Application will be made through the Website (www.psyathome.com) or through the URL mycoach.psyathome.com.

 

In order to use the Application, it will be necessary to register and initiate the corresponding session in it, for which the present Terms and Conditions and the Privacy Policy of the same must be accepted.

 

Access to and use of the Application implies acceptance and compliance by the User with the complete content of these Terms and Conditions, as well as the instructions or recommendations that are indicated in each specific case through the Application.

 

The User must be of legal age (over 18 years old) and have sufficient capacity to acquire the obligations derived from their actions through the Application, as well as having previously read and understood these Terms and Conditions. Thus, access to the Application by minors is totally prohibited. However, in case of access to the Platform and registration by a minor, it will be presumed that access has been made with the prior and express authorization of their parents, guardians or legal representatives, without prejudice to Psy@Home reserves the Right to carry out as many verifications as deemed appropriate.

 

2.2. Registry

 

In order to access and use the different functions of the Application, it will be necessary to register and create an Account in it following the procedure established for that purpose. For the creation of the Account, the User may choose one of the methods established below:

 

i. Select a plan and pay for it. Payment must be made through Credit Card.

ii. Create an account by selecting the username and password that you will use in accordance with the complexity rules required by myCoach, which must be personal and non-transferable, and cannot be communicated to third parties, not even temporarily. In any case, it will be the responsibility of the User the illicit use of the Application by any illegitimate third party who uses, for this purpose, his password due to careless use or loss of it. In case it is known or suspected that the password is being used by third parties, the User must modify it immediately (from the profile, within the myCoach Account) and communicate this circumstance to Psy @ Home through the customer service. Until such events are communicated, Psy@Home will be exempt from any liability arising from the misuse of identifiers or passwords by third parties.

ii. Complete the initial assessment.

 

Registration to the Platform is subject, as indicated in point "i.", To the payment of one of the plans (See "Plans and Services").

 

The data provided during the myCoach registration process must be correct, as it will be the only way that Psy @ Home. will have to be able to interact and correctly manage the relationship with the Users. In no case will Psy @ Home be responsible for the correctness of the registration data provided, so the User will be the one who will have to answer for the possible consequences, errors and failures that arise due to the lack of quality of these data.

 

When personal data is provided through the Application forms, it will be necessary for the User to previously accept the Privacy Policy . At Psy @ Home we are committed to the privacy of our Users, therefore, we put at your disposal different communication channels through which you can consult us with any question about the processing of your data.

Psy @ Home can supervise all registration requests and may deny registration and / or access to the Platform, as well as the services and functionalities offered through it, in order to guarantee that the User meets the requirements necessary for the use of the services provided through the Application, or if the Terms and Conditions are breached.

 

The creation of a User account is personal and non-transferable. The User will receive a registration confirmation email at the email address provided.

 

2.3. Low

 

The User may unsubscribe from the Platform whenever he wishes after the first two months from the moment of subscription have elapsed, by means of a written communication to Psy@Home through the following address: info@psyatwork.com or through the communication channel enabled for this purpose, indicating your email and proving your identity.

 

In any case, the User may request a new registration, and Psy@Home may not admit said registration when the provisions of the Terms and Conditions are breached.

 

Psy@Home may not admit said registration when there is a conflict or controversy between the parties or when said conflict has been resolved with acknowledgment of fault or negligence of the User and / or causing damage to Psy@Home, its collaborators and associates, or its Users, clients or potential clients.

 

On the other hand, in the event that a User breaches any of the stipulations contained in the Terms and Conditions and / or in the applicable regulations, Psy@Home will be empowered to suspend or cancel the profile of said User automatically and without prior notice, and in no case will such suspension or cancellation give the right to any compensation. For these purposes, Psy@Home may inform and collaborate in a timely manner with the competent police and judicial authorities if it detects any violation of current legislation or if it suspects the commission of a crime.

 

2.4. Returns

 

The User can proceed to request the refund in its entirety as long as individual sessions have not been held by videoconference with one of the Professionals.

 

 

3. Platform operation

 

3.1. Professional services contracting process

 

 

The payment method enabled in the Application is Bank Card. The payment of the amounts will be made through the payment gateway Stripe Payments Europe, Ltd, whose conditions can be consulted on the following website https://stripe.com/es/ssa, so that Psy@Home will not have , in no case, access to the bank details provided, which, in any case, will be directly managed by financial entities through the aforementioned payment gateway.

 

An email will be sent to the User through the payment gateway with the invoice issued for the different professional services provided. The Platform will not be responsible in the event that the User has provided an incorrect account.

In accordance with the provisions of Royal Decree 1619/2012, of November 30, which approves the Regulation that regulates billing obligations, through the issuance of said Invoice, all obligations and requirements of issuance and provision of the invoice.

 

With the acceptance of these Terms and Conditions, the User expresses his express consent to receive the Invoices electronically through the payment gateway.

 

The User will lose the right of withdrawal once he has started to use myCoach in accordance with the provisions of Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of the Consumers and Users and other complementary laws (“TRLGDCU”).

 

Notwithstanding the foregoing, it will be understood that there may be a partial refund of 50% on the amount paid in the event that the User, once contracted the services, when no video call has been made with a Professional. In the event of having made at least one video call with a Professional, the User will not be entitled to a refund of the amounts.

In those cases in which the User accesses the Platform through a promotional code or discount, the refund will be proportional to the amount paid.

 

The Subscription contracted will be automatically renewed at the end of the corresponding subscription period, unless you deactivate automatic renewal before the end of the subscription period. Cancellation will take effect on the last day of the current subscription period.

 

 

4. Rules of use of the platform

Access to or use of the Platform for illegal or unauthorized purposes, with or without economic purposes is not allowed. The User will be solely responsible for said illegitimate activity. In particular, and without the following list being absolute or limiting, it is prohibited:

  1. Use the Application in a way that may cause damage, interruptions, inefficiencies or defects in its operation or in the device of a third party;

  2. Use the Application for the transmission, installation or publication of any virus, malicious code or other harmful programs or files;

  3. Use the Application in a way that constitutes a violation of the rights of Psy@Home or of any third party;

  4. Use the Application to transmit or publish any material of a defamatory, offensive, racist, vulgar, degrading, pornographic nature, or of an obscene or threatening nature or that may cause annoyance to any person;

  5. Use the Application to offer professional services of an illegal, humiliating nature or that involve activities contrary to law (such as, for example, prostitution, extortion services, theft, threats or assaults); or for those who do not have the corresponding licenses, certificates and / or qualifications to perform said professional services.

  6. Using the Application illegally, against good faith, morals and public order;

  7. Access or interact with the Application with a false identity, impersonating third parties or taking any other action that may give rise to confusion about the identity of the origin of a message;

  8. Access without authorization to any section of the Application, to other systems or networks connected to it, to any Psy@Home server, by means of hacking or falsification, extraction of passwords or any other illegitimate means;

  9. Use the Application to collect personal data from other Users.

  10. Breach, or attempt to breach, the security or authentication measures of the Application, of any network connected to it, or the security or protection measures inherent to the content hosted on the Application.

  11. Carry out any action that causes a disproportionate or unnecessary saturation in the Platform infrastructure or in the Psy@Home systems or networks as well as in the systems and networks connected to the Application; or

  12. Entering false data, whether or not the User is aware of said circumstance.

 

If any of the above obligations are breached, Psy@Home may take the appropriate measures, even being able to delete or block the User's Account, without the possibility of any compensation for the damages caused.

 

In order for the Application to be a safe environment, and to protect our Users, it is strictly forbidden to publish information or content through the Application that:

  1. They may be considered as a violation in any way of the fundamental rights to honor, personal and family privacy or the image of third parties and, especially, of minors;

  2. Include photographs or collect images or personal data of third parties without having obtained the appropriate consent of their owners;

  3. Violate the secrecy of communications or imply an infringement of intellectual and industrial property rights or of the regulations governing the protection of personal data;

  4. Contain any material or information that is illegal, racist, obscene, pornographic, abusive, defamatory, misleading, fraudulent or in any way contrary to morality or public order;

  5. Contain "SPAM" and / or links to sites unrelated to the corresponding space; or

  6. Include advertising or commercial communications, for the issuance of messages for advertising purposes or for data collection for the same purpose.

Failure to comply with any of the above prohibitions by the User will mean that the User is solely responsible for any claim that occurs as a result of them. Even if there is no claim from a third party, DMS reserves the right to prevent said User from accessing the Platform.

 

Psy@Home does not control the content published by the Users of the Platform and does not assume any responsibility for said content. However, Psy@Home reserves the right to supervise and / or moderate any content published on the Platform that violates these General Contract Conditions or the Privacy Policy, as well as to edit or delete it.

Likewise, we ask Users that, in the event that any information or content is observed or found on the Platform that may be inappropriate or contrary to current regulations and / or the conditions of the Platform itself, bring said circumstance to the attention immediately from Psy@Home through the different means available for it.

When the user uses the Psy@Home platform, information about their visit is automatically collected. This includes the pages you click on and the data you provide. We use this information to obtain information about how the Application is used, and to provide you with e-Coaching services. All the information that the user enters in the Application, such as their data in their profile, tasks, responses and results of the evaluations, will be subject to the terms and conditions specified below in section 4.

Each time a user visits Psy@Home or the Application, data about their visit is automatically collected. This includes:

- The page the user entered first

- The pages that the user visits

- If the user has visited the website before

- From which website the user came

- The time the user stayed on the page

- The operating system, the type of browser and the version that the user uses

3. Why do we collect data about our Clients' visits?

 

We use non-personal data from cookies, “web beacons” and log files to know how the user uses the Psy@Home website and the Application. We monitor which pages users consider more or less interesting. This helps us to continue developing and improving Psy @ Home and the App, making them easier to use and more relevant to users. We use the data collected on trends and user behavior both internally and publicly for marketing purposes, such as trend reports based on visitor statistics. This type of data is collected for all or for large groups of visitors and does not contain any information that can identify the user on a personal level. If the user is registered in the Psy @ Home Application, cookies are also used to pre-fill the access fields.

1. Scope and use of the subscription

 

These terms and conditions govern the rights and obligations in relation to the use of the services of Psy@Home (and its myCoach Application) and www.psyatwork.com and other national Internet LTD companies, provided by the parent company Psy@Work SL , based at Carrer Mallorca 281, 2, 1, Barcelona, ​​Spain. Psy@Home services include - but are not limited to - the Psy@Home website, FaceBook page, and E-Coaching app (myCoach). The subscription grants the user (that is, the legal person who has subscribed to the Application) the right to use the E-Coaching Psy@Home (myCoach) application. The subscription cannot be used by other people or organizations other than the user in question.

 

 

2. Acceptance of the subscription

 

By subscribing to the services provided by Psy@Home you agree to the Terms of Use described below.

 

 

3. Duration and termination of the subscription

 

Psy@Home offers paid subscriptions. The subscription begins from the date the user registers with Psy @ Home. The subscription can be canceled at any time in "My Profile"> Cancel subscription.

 

 

4. User data

 

The user is the owner and may use his data stored in the Application at his own discretion. Customers who sign up for Psy@Home will have a username and password of their own choosing. Psy@Home is not responsible for the misuse of passwords that the user may incur as a registered user. It is the user's responsibility to properly manage the user names and passwords that are provided to access as a registered user.

 

 

5. Operational stability

 

It is Psy @ Home's goal to provide the highest possible degree of operational stability, but it cannot be held responsible for any breakdown caused by factors beyond its control. Such faults include - but are not limited to - power failures, modem equipment errors, ADSL connections, telecommunications connections, or the like. In any case, Psy @ Home aims to restore normal operations as quickly as possible.

 

 

6. Maintenance of the application

 

Psy @ Home has the right to make operational changes to the Application in order to improve the service it provides, or otherwise (for example, developing or replacing technical equipment, maintenance or software update) without the need to give prior notice to the user. . In some circumstances, it may be necessary to suspend access to the Application, normally between 10 p.m. and 7 a.m. If possible, the user will be notified in advance of such suspension. Psy@Home will not be responsible for the consequences of such suspension.

 

 

7. Rights

 

The Application is protected by copyright and remains the property of Psy@Work SL Psy @ Work SL may transfer its rights and obligations under this agreement to any affiliate, subsidiary or business unit of Psy@Work SL, at any time. Except in the cases mentioned above, the rights and obligations under this agreement cannot be transferred to any third party without the written consent of the other party.

 

 

8. Responsibility of Psy@Home

Psy@Home has taken reasonable steps to ensure that the Application is free of viruses, but no guarantee is made that the Application is free of viruses or the like, and Psy@Home shall have no liability if this is not the case. To the extent permitted by Spanish law, Psy@Home disclaims all warranties with respect to the Application, whether express or implied, including - but not limited to - any implicit warranty of fitness or suitability for any particular purpose.

Psy@Home is not responsible for third-party solutions that are available and / or integrated in the Application. Therefore, Psy @ Home will not be responsible for the accuracy, completeness, quality or reliability of the information or the results obtained through such third-party solutions. Similarly, Psy@Home is not responsible for the availability, security, and functionality of third-party solutions, including any damage and / or loss that may arise from the use of third-party solutions.

 

Psy@Home will not be liable to the user for any loss or damage caused (including business interruption) arising directly or indirectly, except to the extent that such liability cannot be legally excluded under applicable law.

 

Except in the event of death or personal injury caused by the negligence of Psy@Home, its employees, agents or authorized representatives, for which no limit applies, Psy@Home's liability shall be limited to the lesser of the values ​​of the payments made. by the user during the period of 12 months before the occurrence of the incident that gives rise to liability or 1,000 euros (one thousand euros).

 

 

9. Data protection and confidentiality

 

The user confirms that he is authorized to instruct Psy @ Home to process any such information and that all instructions given will be legal. Psy@Home is obliged to keep any information received about the user secret and will not reveal said information to any third party, except when required by any court or regulatory authority, and in that case only to the extent necessary.

 

Psy@Home has taken the necessary technical and organizational security measures to prevent system information from being accidentally or illegally destroyed, lost or wasted, and to prevent such information from falling into the hands of any unauthorized party or from being misused or treated. in any other way contrary to the Data Protection Law. The user agrees that a copy of the bank certificate issued to the user by his bank can be stored in the Psy@Home database and in an external database. The user also agrees that the data retrieved from the user's bank through a banking source is available and stored in the Application.

 

 

10. Entire Agreement

 

These Terms and the subscription contain the entire agreement between the parties and supersede all previous correspondence or communications, whether written or oral. Psy@Home may amend these Terms and Conditions as necessary from time to time, provided that Psy@Home provides its users in writing no less than 40 days in advance. In that case, all those amendments will apply to the next subscription renewal.

 

 

12. Disputes

 

These Terms will be governed and interpreted in accordance with the laws of Spain, and the Courts of Spain will have exclusive jurisdiction to determine any dispute related to these Terms or their object.
